Former Audi CEO Rupert Stadler, who was arrested in June on suspicions of fraud and false advertising, has filed an appeal with the German courts to be released from prison.

Stadler, who is being held in a facility in the German city of Augsberg, has stopped giving statements to prosecutors after first being cooperative, news agency Reuters reports. A Munich court is currently reviewing his appeal to be released.

The 55-year old German businessman was arrested in June for his suspected ties to Volkswagen Group’s diesel emissions scandal. Suspicions around Stadler came to light as authorities began to look into those behind the diesel scandal, which saw millions of Audi and VW vehicles fitted with illegal emissions control devices. They believed Stadler was attempting to influence key witnesses in the investigation – a charge he has so far denied. His arrest came nearly three years after the diesel emissions scandal first came to light.

Stadler was removed from his position as Audi CEO shortly after his arrest. He has been replaced by interim CEO Albert Schot, who formerly served as a sales executive with the automaker.
